These terms govern your use of this website and any purchase you make from GadgetDeals KE Limited. By placing an order you accept them.
Nothing in these terms removes rights you have under the Consumer Protection Act, 2012 or the Sale of Goods Act (Cap 31).
1. Eligibility
- You must be at least 18 years old and legally able to enter a contract.
- You must provide accurate delivery and contact details. We are not responsible for a failed delivery caused by details you gave us incorrectly.
- We may decline or cancel any order where we suspect fraud, where the buyer is reselling in breach of these terms, or where a pricing error is obvious.
2. Product descriptions and grading
We sell devices in two conditions, and every listing states plainly which it is. "Brand New" means factory sealed, never opened and never activated, supplied with full manufacturer accessories. "Ex-UK" means a pre-owned handset imported from the United Kingdom.
Ex-UK devices are described using three cosmetic grades — Like New, Excellent and Good — defined on each product page and in the Warranty Policy. Cosmetic grades apply to ex-UK stock only and never to sealed stock.
We will never describe an ex-UK device as new. If a listing does not say Brand New, the device is pre-owned.
A small number of handsets are offered as "Sold with a known fault". These have a specific defect that we identify in plain language on the listing, in your cart, at the final checkout step and on your invoice. They are priced accordingly. Every other function on them has been tested and works, and the warranty covers everything except the named fault. We will never place a handset with a known defect into an ordinary cosmetic grade.
Grade describes appearance only. Every device, at every grade, passes the same 42-point functional test before listing.
Photographs on product pages are representative illustrations of the model and colourway. The actual cosmetic condition of your unit is governed by the grade you select, and we photograph individual units on request before dispatch.
Battery health figures are minimums measured under load, not maximums. Charge-cycle counts are the reading taken at intake.
3. Pricing
- All prices are in Kenya Shillings and include VAT where applicable.
- Delivery is charged separately and shown before you commit to the order.
- Prices can change at any time, but never after you have placed and paid for an order.
- If a price is obviously wrong — an evident typing or system error — we will contact you, cancel the order and refund you in full rather than fulfil it at the erroneous price.
4. Orders and acceptance
Your order is an offer to buy. A contract is formed only when we send an order confirmation and the device is allocated from stock. Payment being taken does not by itself form a contract.
Because each unit is a unique serialised item, stock can sell out between adding to cart and paying. Where that happens we will offer an equivalent unit or refund you in full within three working days.
5. Payment
- We accept M-Pesa STK Push, M-Pesa Paybill, bank transfer, Visa and Mastercard, Lipa Pole Pole and, in eligible areas, cash on delivery.
- Ownership of a device passes to you when payment has cleared in full and the device has been delivered.
- Risk passes to you on delivery, or on collection where you collect in person.
- Lipa Pole Pole is governed by its own schedule presented at checkout, which forms part of these terms when you select it.
6. Shipping and delivery
Delivery times shown at checkout are estimates in business days and depend on your county. Full detail is in the Shipping Policy, which forms part of these terms.
If nobody is available to receive an order, the courier will attempt redelivery once. After a second failure the order returns to us and a redelivery fee applies.
7. Returns, cancellation and warranty
You may cancel and return an unused device within 7 days of delivery for any reason. Faulty devices are covered for 12 months. The Return & Refund Policy and the Warranty Policy set out the detail and both form part of these terms.
8. User accounts
- You are responsible for keeping your password confidential and for activity on your account.
- Tell us immediately if you suspect unauthorised access.
- We may suspend an account used for fraud, abuse or any breach of the Acceptable Use Policy.
- You may close your account at any time; we will retain records we are legally required to keep.
9. Intellectual property
The site, its design, text, code and graphics are owned by us or licensed to us. You may not copy, scrape, republish or use them commercially without written permission.
Apple, iPhone, iPad, MacBook and AirPods are trademarks of Apple Inc. Samsung and Galaxy are trademarks of Samsung Electronics. We are an independent reseller and are not affiliated with, authorised by or endorsed by either company. Trademarks are used descriptively to identify the products we sell.
10. Limitation of liability
Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under Kenyan law.
Subject to that, our total liability arising from an order is limited to the amount you paid for that order.
We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data. You are responsible for backing up your own data before sending a device to us for trade-in or repair.
11. Events beyond our control
We are not liable for delay or failure caused by events outside our reasonable control, including network outages, courier disruption, civil unrest, natural events, or changes in law. Where such an event continues beyond 30 days, either party may cancel the affected order and we will refund in full.
12. Governing law and disputes
These terms are governed by the laws of Kenya and the courts of Kenya have exclusive jurisdiction.
Before going to court, both parties agree to attempt resolution in good faith: raise the complaint with us in writing, and we will respond substantively within 14 days. If that fails, the parties may refer the dispute to mediation under the Nairobi Centre for International Arbitration rules before commencing proceedings.
13. Changes to these terms
We may amend these terms. The version in force is the one published when you place your order, and we archive previous versions for reference on request.
